Scoopers : Terms of Use
The use of the Scoopers website and service is subject to the terms and conditions below. If you register or otherwise use Scoopers, you agree to the below terms and conditions. Scoopers is offered by AC Scoop NV, Chamber of Commerce Curaçao 122760.
Registration requirements
To use Scoopers you must register for an account using your e-mail address. Logging in thereafter activates your account.

It is your responsibility to keep the password for the account private from others. We are not responsible for any misuse of the password and may assume that anything that occurs using your account is under your supervision and risk. If you suspect that a third party has gained access to your password or account, you must inform us as soon as possible so we can take appropriate steps to prevent or stop abuse.

You may only operate one account. If Scoopers sees suspicious behaviour, such as multiple logins from different IP-addresses, Scoopers may temporarily block your account and contact you to resolve the issue.

If you do not log in at least once every twelve months, we may disable or remove your account.
Your contributions
You are free to decide which contributions (including profile information) you want to publish on Scoopers, for example texts, photos, music, sound, videos, hyperlinks, discussions and status updates.

Contributions must not violate applicable law. In particular, contributions may not :

- contain misleading, fraudulent, defamatory, libelous, harassing, threatening, racist, homophobic or otherwise objectionable content, or encourage illegal activities of any kind, including incitement to hatred towards persons or groups.

- contain malicious content such as spyware or viruses or hyperlinks to external websites that provide such malicious content.

- infringe on third party copyrights, trademarks or similar rights, for example by including images or inline links to externally hosted images without express permission of the copyright holder (or a statutory right to use such images for the purpose of your publication).

- violate the privacy of other members, our employees or third parties.

Contributions of an adult nature may only be published on those locations explicitly designated as welcoming such content. Posting adult content in other locations may result in termination of your account.

Scoopers does not screen or moderate any contributions in advance. However, Scoopers may block, adapt or remove any publication by you if Scoopers, at its sole discretion, determines that such publication is likely to be unlawful or in violation of these terms of use. Scoopers does not need to consult or inform you in such a case. Scoopers is not liable for any damages you may suffer as a result of its actions under this article.
Your profile
Using your account you can maintain your profile, which includes information about yourself that will be used on various parts of the website. Users of Scoopers can see an overview of your contributions on your profile. Further, you can exchange messages with other users.

By default, all users and external search engines such as Google can view your profile and thus obtain an overview of your contributions. You can use the privacy settings to control who can see which contribution.
Group management
Scoopers offers groups where people can make contributions around a particular topic.

The creator of the group is the initial moderator, and thereby is in control of the group. This person may appoint other moderators or relinquish control to another person. If the group has no activity for a prolonged period, or if the moderator’s behaviour is negatively affecting the mood or operation of the group, Scoopers may at its discretion itself appoint a new moderator.

The moderator(s) decide the topic of the group and what is and is not appropriate. Scoopers will not intervene in a debate whether a contribution is on topic or whether a removal was justified.

Before you can post to publicly-visible groups, your account must be verified by means of an SMS message with a challenge sent to your mobile phone.
Intellectual property
Scoopers respects the intellectual property of others, and we expect you to do the same.

You retain the full copyright on contributions you make on Scoopers. By making contributions, you grant Scoopers and all other recipients a non-exclusive license to publish these contributions on the website, including inclusion in search results, RSS feeds, e-mail newsletters and other channels that are part of Scoopers. This license ends when you remove the contribution from Scoopers.

This license includes the right to change these materials. While Scoopers will strive to publish your name in connection with these materials if reasonably practical, you waive (to the extent legally permitted) any claim to demand acknowledgment on Scoopers as author.

You authorize Scoopers to take legal action against third parties in case of publication of your materials in the form in which they have been published on Scoopers.

In case you make contributions to which a third party has rights, you warrant that the third party has granted permission for the use on Scoopers or that your publication falls under a legal exception such as fair use or the right to quote. In any case you must identify the source of third-party information.

You agree to fully indemnify us for any third-party claims alleging that your publications on the website violate their rights or otherwise are unlawful.

You are not authorized to spider, copy or download the entire content or substantial parts of Scoopers. Scoopers uses automated means to detect downloading of the entire content or substantial parts thereof. In such a case Scoopers may block your access temporarily or permanently, without liability for Scoopers.
Availability and maintenance
Scoopers will use its best efforts to keep the website available at all times, but Scoopers cannot guarantee a 100% availability.

Scoopers may adapt the website and associated hard- and software to correct errors and to improve the functionality.

Scoopers may temporarily disable access to the website or parts therefor for the purposes of maintenance or upgrades to the website and related systems. Scoopers will strive to schedule such maintenance or upgrades during times when average usage of the website is low and will announce such maintenance or upgrades in advance if possible.
Limitation of liability
As Scoopers is offered to you free of charge, Scoopers cannot accept liability for damages as a result of errors or faults attributable to Scoopers, unless and to the extent dictated otherwise by mandatory law.

Scoopers shall not be liable for any consequential, special, punitive and/or incidental damages, including loss of profits or fines imposed by regulatory bodies, arising out of or in connection with the Service, even if advised of the possibility of such damages, except with respect to damages incurred as a result of the gross negligence or willful misconduct of Scoopers.

Scoopers accepts no liability for contributions made by other users. Scoopers will investigate any complaints and decide at its discretion what to do.
Term and changes of the agreement
These terms of service apply upon registration and until your account is terminated.

Both you and Scoopers may terminate this agreement at any time. You don’t have to provide prior notice; Scoopers has to provide one months’ notice except in case of a violation of these terms of service. If you do not log in at least once every twelve months, we may disable or remove your account without further notice.

These terms may change at any time. Scoopers will give at least fourteen days’ notice by means of an announcement on Scoopers.

Your use of the Service after these thirty days constitutes acceptance of the changed terms.
Miscellaneous terms
Use of the Service shall be governed by and construed in accordance with the laws of Curaçao without consideration of its conflict of law provisions.

Any disputes arising out of or in connection with the Service shall be brought before the competent courts for the principal place of business of Scoopers, unless mandatory law provides otherwise.

In the event that any one or more of the provisions of this agreement is determined by a court of competent jurisdiction to be invalid, unenforceable, or illegal, such invalidity, unenforceability, or illegality shall not affect any other provisions of this agreement, and the agreement shall be construed as if the challenged provision had never been contained herein. The parties further agree that in the event such provision is an essential part of this agreement, they will immediately begin negotiations for a suitable replacement provision.
